  • che l' Ufficio di tassazione ha notificato il 13 febbraio 1995 la tassazione IC 1993-94 a __________ __________ esponendogli una sostanza di fr. 22'146.-- e il reddito di fr. 1'300.--;

  • che il 2 marzo 1995 __________ __________ ha reclamato, attirando l'attenzione dell'UT sul fatto che la sostanza era gravata da usufrutto a favore della madre __________;

  • che con decisione 24 aprile 1995 l'UT ha stralciato dalla partita fiscale del contribuente la sostanza, esponendogli unicamente il relativo reddito;

  • che con tempestivo ricorso del 3 maggio 1995 __________ __________ chiede lo stralcio anche del reddito della sostanza;

  • che secondo l'art. 12 LT i beni gravati da usufrutto o costituiti in enfiteusi e i relativi redditi sono aggiunti agli elementi imponibili del beneficiario;

  • che pertanto l'imposta, sia per la sostanza sia per il reddito, viene messa a carico di chi ha il godimento del bene (RTT 1986 p. 491 ss.; Bottoli, Lineamenti di diritto tributario ticinese, ed. 1977, p. 80; ASA 19 p. 20);

  • che il contratto di scioglimento della comunione ereditaria del 27 dicembre 1990, noto all'autorità di tassazione, prevede chiaramente che sia l'immobile di __________ che quello di __________. __________ sono gravati da usufrutto a favore della madre del ricorrente;

  • che verosimilmente per una svista l'UT ha omesso di stralciare dalla partita del contribuente il reddito della sostanza, come risulta implicitamente confermato dalla tassazione IC 1995-96, notificata nel frattempo, in cui non viene più esposto alcun reddito della sostanza;

Per questi motivi,

visto per le spese l'art. 185 LT

dichiara e pronuncia

  1. Il ricorso è accolto.

§ Di conseguenza la decisione su reclamo del 24 aprile 1995 è riformata nel senso che è stralciato il reddito della sostanza di fr. 1'300.--.

§§ Gli atti del procedimento vengono pertanto retrocessi all'UT per l'emissione del nuovo conteggio.

  1. Non si prelevano né spese né tassa di giudizio.

  2. Intimazione alle parti.

  3. Il presente giudizio è definitivo (art. 184 cpv. 3 LT).
