in fatto ed in diritto

  • che, nel suo ricorso, __________ __________ rileva una contraddizione fra il dispositivo della decisione su reclamo impugnata, secondo cui il suo gravame è stato "ammesso come a domanda", ed il calcolo del reddito del lavoro ai fini dell'IC e dell' IFD;

  • che, infatti, mentre egli ha chiesto la deduzione di fr. 802.90, corrispondenti ad una provvigione da lui versata nel corso del 1994, l'autorità di tassazione ha ridotto il suo reddito del lavoro di soli fr. 121.- in media annua;

  • che, interpellato dalla Camera di diritto tributario, l' Ufficio di tassazione di __________ -__________ ha confermato, con scritto del 13 settembre 1995, di essere incorso in un errore di calcolo;

  • che il reddito imponibile deve pertanto essere corretto in fr. 52'839.- per l'IC e in fr. 59'046.- per l'IFD.

Per questi motivi,

visti per le spese gli art. 144 LIFD e 231 LT 1994

dichiara e pronuncia

  1. Il ricorso è accolto.

§ Di conseguenza, la decisione su reclamo del 21 agosto 1995 è riformata nel senso che il reddito imponibile è corretto in fr. 52'839.- per l'IC e in fr. 59'046.- per l'IFD.

  1. Non si prelevano né tassa di giudizio né spese.

  2. Intimazione alle parti.

  3. Per l'IC il presente giudizio è definitivo (art. 230 cpv. 3 LT 1994). Per l'IFD è ammesso il ricorso entro 30 giorni al Tribunale federale in Losanna (art. 146 LIFD).
