  1. L’ Ufficio di tassazione di Locarno notificava il 19 dicembre 1994 la decisione su reclamo in materia di IC 1991-92 ad __________ __________ __________, in cui determinava il reddito imponibile in fr. 49’265.-- di media annua e la sostanza in fr. 15’158’358.--.

  2. Con tempestivo ricorso del 19 gennaio 1995 __________ __________ __________ contestava la suddetta decisione, rilevando di aver dovuto far fronte a elevati oneri ipotecari, che annullerebbero sia il reddito sia la sostanza imponibili.

  3. Dopo numerose sollecitatorie il ricorrente ha potuto finalmente produrre la documentazione richiestagli già dall’ Ufficio di tassazione, tra cui il riparto d’imposta intercantonale provvisorio del Canton Lucerna, che gli è stato notificato soltanto il 3 giugno

Invitato da questa Camera a esprimersi sulla nuova documentazione, l’ Ufficio di tassazione di Locarno con scritto del 2 luglio 1996 comunicava che alla luce della documentazione prodotta con il ricorso sembra rendere del tutto legittima la totale esenzione del contribuente per gli anni 1991-92, rilevando tuttavia che meriterebbero ulteriore approfondimento gli aspetti inerenti ai costi da riattivare e al loro ammontare.

  1. Visto quanto precede e considerato in particolare come nell’ambito della presente procedura sia stato possibile acquisire agli atti la documentazione necessaria per una corretta tassazione, questa Camera non può far altro che annullare in ordine la decisione su reclamo del 19 dicembre 1994 e retrocedere gli atti all’ Ufficio di tassazione per nuova decisione suscettibile d’essere impugnata.

Per questi motivi,

visto per le spese l’ art. 185

dichiara e pronuncia

  1. Il ricorso è evaso a’ sensi dei considerandi.

§ Gli atti del procedimento sono retrocessi all’ Ufficio di tassazione per nuova decisione su reclamo in materia di IC 1991-92.

  1. Non si prelevano né tassa di giustizia né spese.

  2. Intimazione alle parti.

  3. Per l'IC il presente giudizio è definitivo (art. 184 cpv. 3 LT 1976).
