Omnilex summary

The Ticino cantonal criminal court, sitting through Judge Agnese Balestra-Bianchi, dealt with the prosecutor’s request to confiscate and destroy 21.7 grams of hashish seized at Chiasso railway station. The holder of the drugs could not be identified, and the criminal proceedings against unknown persons had already been abandoned. The court held that Article 58 CPS allows confiscation and destruction independently of the punishment of any specific person when the object is linked to an offence and threatens public safety, morality, or public order. It ordered confiscation and destruction and waived all fees and costs.

Ignoti

Considerato - che il 6 gennaio 2004, a Chiasso, presso la Stazione ferroviaria, le GFC hanno rinvenuto 21.7 grammi lordi di haschisch (rep. SAD 5005/04);

  • che dagli accertamenti esperiti non è stato possibile risalire al detentore dello stupefacente;

  • che il Procuratore pubblico con decreto NLP 2080/04 del 15 giugno 2004 ha abbandonato il procedimento contro ignoti, motivo per cui è ora a chiedere la confisca e la distruzione dello stupefacente sequestrato;

  • che giusta l'art. 58 CPS il giudice, indipendentemente dalla punibilità di una determinata persona, ordina la confisca e la distruzione degli oggetti che hanno servito o erano destinati a commettere un reato o che costituiscono il profitto di un reato se tali oggetti compromettono la sicurezza delle persone, la moralità o l'ordine pubblico;

  • che lo stupefacente in oggetto realizza quanto previsto da detta norma e di conseguenza deve essere confiscato e distrutto.

Key legal question

Whether the seized hashish had to be confiscated and destroyed despite the offender being unknown.

Extracted holding

Yes. Narcotics that serve or are intended to serve the commission of an offence may be confiscated and destroyed regardless of the punishability of any specific person.

Extracted reasoning

The drug fell within Art. 58 CPS because it was an object linked to an offence and, by its nature, affected public safety, morality and public order; therefore confiscation and destruction were ordered independently of any conviction.

Key legal question

Whether court costs or fees should be charged.

Extracted holding

No fees or costs were levied.

Extracted reasoning

The order expressly provided that no taxes or costs would be taken.
