la decisione 2 agosto 2004 del consiglio di amministrazione CO1 che delibera alla CO2 la fornitura di 300 letti d'ospedale;
preso atto che il 4 ottobre 2004 il patrocinatore del ricorrente ha comunicato di ritirare il ricorso;
rilevato la rinuncia ad esigere un'indennità per ripetibili sia da parte del patrocinatore dell'__________ che di quello della CO2, la causa può essere stralciata dai ruoli senza assegnazione di ripetibili e con aggravio limitato di spese e tassa di giustizia;
considerato pertanto che il procedimento è così esaurito;
decreta:
Il ricorso è stralciato dai ruoli.
Le spese e la tassa di giustizia di fr. 300.-- sono a carico della ricorrente.
Non si assegnano ripetibili.
