statuendo sul ricorso 7 maggio 2002 di

contro

la risoluzione 17 aprile 2002 (n. 1806) del Consiglio di Stato, che ha respinto l'impugnativa presentata dall'insorgente avverso la decisione 15 febbraio 2002 del Dipartimento delle istituzioni, Sezione dei permessi e dell'immigrazione, in materia di revoca del permesso di dimora;

viste le risposte:

  • 17 maggio 2002 del Dipartimento delle istituzioni,

  • 21 maggio 2002 del Consiglio di Stato;

richiamata la sentenza 17 febbraio 2003 del Tribunale federale;

letti ed esaminati gli atti;

ritenuto, in fatto e in diritto

che l'11 luglio 1997 la cittadina russa __________ __________ () si è sposata ad __________ con il cittadino elvetico __________ __________ (), ottenendo per questo motivo un permesso di dimora annuale, in seguito regolarmente rinnovato, l'ultima volta fino al 30 giugno 2002;

che, con decisione 15 febbraio 2002, il Dipartimento delle istituzioni ha revocato il permesso di dimora alla ricorrente, ritenendo manifestamente abusivo appellarsi a tale connubio al fine di poter continuare a dimorare sul territorio elvetico perché non viveva più insieme al marito da diversi mesi (art. 4, 7, 9, 12, 16 LDDS e 8 ODDS);

che la suddetta risoluzione è stata confermata sia dal Consiglio di Stato il 17 aprile 2002, sia dal Tribunale cantonale amministrativo il 19 giugno 2002, che non avevano ritenuto determinante la dichiarazione 6 marzo 2002 con la quale il marito della ricorrente attestava la ripresa della vita in comune;

che con sentenza 17 febbraio 2003, il Tribunale federale ha accolto il ricorso di diritto amministrativo presentato da __________ __________ e ha rinviato la causa al Tribunale cantonale amministrativo per nuovo giudizio, previo completamento dell'accertamento dei fatti;

che l'alta Corte ha considerato che una separazione di alcuni mesi non è un indizio sufficiente per ritenere che i coniugi non avessero una reale volontà di ricomporre la loro unione coniugale in maniera definitiva;

che giusta l'art. 65 PAmm, il Tribunale cantonale amministrativo può annullare la decisione impugnata e rinviare la causa all'istanza inferiore segnatamente nei casi in cui questa ha accertato la fattispecie in modo incompleto;

che, verificandosi in concreto tale ipotesi, il ricorso va accolto e gli atti rinviati al Consiglio di Stato, affinché statuisca nuovamente sul ricorso come indicato dal Tribunale federale, segnatamente previo completamento degli accertamenti necessari al fine di determinare con esattezza quando i coniugi __________ si sono separati e l'evoluzione dei loro rapporti coniugali;

che, dato l'esito, si prescinde dal prelievo di una tassa di giustizia e delle spese;

che lo Stato del Cantone Ticino deve rifondere alla ricorrente un'adeguata indennità per ripetibili relativa al presente giudizio di rinvio (art. 31 PAmm).

per questi motivi,

visti gli art. 1, 4, 7 LDDS; 16 ODDS; 8 CEDU; 100 cpv. 1 lett. b n. 3 OG; 10 lett. a LALPS; 3, 18, 28, 31, 43, 46, 60, 61, 65 PAmm;

dichiara e pronuncia:

  1. Il ricorso è accolto come ai considerandi.

§. Di conseguenza:

1.1 la decisione 17 aprile 2002 (n. 1806) del Consiglio di Stato è annullata;

1.2 gli atti sono rinviati all'Esecutivo cantonale per nuova decisione previo completamento dell'istruttoria.

  1. Non si prelevano né tassa di giustizia né spese.

  2. Lo Stato del Cantone Ticino rifonderà alla ricorrente fr. 600.– a titolo di ripetibili.

  3. Contro la presente decisione, è dato ricorso di diritto amministrativo al Tribunale federale a Losanna nel termine di 30 giorni dall'intimazione.
