la risoluzione 9 luglio 2002, no. 3475, del Consiglio di Stato, con la quale respinge il ricorso dell'insorgente interposto contro la decisione __________ municipio di __________ di concedere a CO 1 l'autorizzazione ad allacciare la loro proprietà alla condotta privata del ricorrente per l'erogazione dell'acqua potabile;
preso atto che il 3 novembre 2004 il patrocinatore del ricorrente ha comunicato di ritirare il ricorso;
ritenuto che i resistenti si sono avvalsi del patrocinio di un legale iscritto all'albo, per cui si giustifica la corresponsione di una indennità per ripetibili;
considerato pertanto che il procedimento è così esaurito;
decreta:
Il ricorso è stralciato dai ruoli.
Le spese e la tassa di giustizia di complessivi fr. 100.- sono a carico del ricorrente, che rifonderà ai resistenti l'importo di fr. 200.- a titolo di ripetibili.
