statuendo sul ricorso 7 maggio 2001 di

contro

la decisione 3 aprile 2001, no. 1505, del Consiglio di Stato che respinge il ricorso 19 febbraio 2001 dell'insorgente avverso la decisione 1. febbraio 2001 del municipio di __________, con la quale gli ordina la demolizione del terrazzo ricavato nella falda del tetto al mapp. n. __________ RFD di __________;

ritenuto che con scritto 15 novembre 2001 il ricorrente ha comunicato che la vertenza si è conclusa positivamente con l'approvazione di una variante oggetto di relativa licenza edilizia e conseguentemente con l'annullamento dell'ordine municipale impugnato;

considerato quanto sopra chiede di stralciare il ricorso dai ruoli, senza addebito di tasse e spese, poiché divenuto privo d'oggetto;

rilevato pertanto che il procedimento è così esaurito;

decreta:

  1. Il ricorso è stralciato dai ruoli.

  2. Non si prelevano né tasse, né spese.
