Omnilex summary

The appellant challenged two Council of State decisions revoking the operating authorizations of two clinics. Before the administrative court decided the merits, the Council of State annulled the challenged revocation decisions and again authorized operation. The appellant then asked that both appeals be declared moot and waived any compensation. The court struck both appeals from the docket as moot and ordered that no court costs, expenses, or party compensation be charged.

Omnilex headnote

Administrative appeal becomes moot when the challenged decision is annulled by the issuing authority during the pending proceedings; the appellate court then strikes the case from the docket for lack of subject matter. In such circumstances, and absent a specific basis to the contrary, no court costs or party compensation are allocated where the proceedings end without a merits ruling (consid. 1-2).

Key legal question

Whether the appeals against the revocation of the operating authorizations had become moot after the Council of State annulled its own decisions.

Extracted holding

Yes. Since the challenged decisions were annulled, the appeals no longer had an object and had to be removed from the docket.

Extracted reasoning

The impugned revocation decisions were withdrawn/annulled by the same authority through later resolutions, which removed the subject matter of the pending appeals.

Key legal question

Whether court fees and party compensation should be awarded despite mootness.

Extracted holding

No. The court ordered no fees, no costs, and no party compensation.

Extracted reasoning

Given the mootness and the appellant’s waiver of compensation, no financial consequences were imposed.
