Summary

The Ticino Administrative Court dealt with appeals against a 9 April 1991 State Council decision concerning a parish tax for 1989. Before the court ruled on the merits, the Parish of __________ notified on 17 January 1996 that, in light of legislative changes, it was withdrawing the appeals. The court therefore struck the case from the roll and ordered that no court fees or costs be levied.

Withdrawal of the appeal; striking from the roll and costs. Where the appellant expressly withdraws the recourse during the pending administrative appeal, the court terminates the proceedings without examining the merits and removes the matter from the docket. In the absence of a substantive adjudication, and where the procedural circumstances so warrant, no court fees or expenses are charged (consid. 1-2).
