preso atto della risoluzione 20 febbraio 1996 con cui il municipio revoca la decisione 2 febbraio 1994 e ripristina la licenza edilizia 25 gennaio 1994;

considerato che il ricorso è così diventato privo d'oggetto;

tenuto conto ai fini del giudizio su spese e ripetibili che l'esito favorevole al ricorrente è stato reso possibile dal giudizio 10 gennaio 1996 del Tribunale della pianificazione del territorio;

visti gli art. 21 LE, 3, 18, 28, 31, 60, 61 PAmm

decreta:

  1. La causa è stralciata dai ruoli poiché divenuta priva d'oggetto.

  2. Non si prelevano né tasse, né spese.
