statuendo sul ricorso del 24 novembre 1994 del
Comune di __________ (rappr. dal __________)
contro
la decisione 8 novembre 1994, no. 9487, del Consiglio di Stato che accoglie il ricorso 26 ottobre 1993 di __________, avverso la decisione 11 ottobre 1993 del Municipio di __________ relativa all'imposizione della tassa d'uso fognatura;
preso atto che in occasione dell'udienza 16 febbraio 1995, dopo discussione, il Giudice Delegato ha sottoposto alle parti una transazione a tenore della quale:
"La tassa d'uso della fognatura per gli anni 1991 e 1992, dovuta dal resistente __________ a favore del Comune di __________ e relativa al mapp. __________, corrisponda al 20 % della tassa piena, ovvero di quella calcolata in applicazione dell'art. 52 cifra 7 del Regolamento delle canalizzazioni (tassa piena per il 1991 = fr. 1217.35; per il 1992 = fr. 1071.85).
Alle parti viene assegnato un termine di 15 giorni per dichiarare se aderiscono o meno alla transazione.
In caso di accettazione il resistente dichiara di rinunciare all'assegnazione di ripetibili.
In caso di adesione alla suddetta transazione il Tribunale cantonale amministrativo stralcerà la causa senza spese."
rilevato che con comunicazioni 23 febbraio e 3 marzo 1995 rispettivamente il municipio di __________ e il resistente __________ hanno accettato la soluzione transattiva di cui sopra;
considerato pertanto che il procedimento è così esaurito;
decreta:
Il ricorso è stralciato dai ruoli.
Non si prelevano né tassa di giudizio né spese.
Non si assegnano ripetibili.
