Omnilex summary

Two appellants challenged two decisions of the Cassa cantonale assegni familiari concerning family allowances. After the Tribunal cantonale delle assicurazioni had set a deadline for the respondent's answer, the appellants informed the court by letter that they were withdrawing their appeals. The court found the cases moot, struck them from the docket, and ordered that no fees or costs be collected.

Omnilex headnote

Withdrawal of an appeal renders the proceedings devoid of object; the appellate court may strike the case from the docket. In such a situation, and absent special circumstances, no court fees or expenses are levied, pursuant to the applicable cantonal procedural law (consid. implicit).
