richiamata l'ordinanza 8 gennaio 2002 con la quale il Tribunale ha assegnato alla parte convenuta il termine di rito per presentare la risposta;
vista la lettera 23 gennaio 2002 della parte ricorrente del seguente tenore:
" Con riferimento alla procedura citata a margine, essendo le parti infine addivenute ad un accordo, Le comunichiamo il ritiro del ricorso presentato il 03.01.2002. La preghiamo pertanto di voler stralciare dai ruoli la causa." (cfr. Doc. _);
rilevato che la causa è divenuta priva di oggetto;
viste le disposizioni della Legge di procedura 6.4.61;
decreta 1. la causa è stralciata dai ruoli;
non si percepiscono né tasse né spese;
