The Ticino cantonal insurance court taxed the fee note submitted by counsel appointed under legal aid after the main case had been decided. The court fixed the remuneration at CHF 1,311.20, VAT included, relying on Art. 21 of the cantonal procedural law. It also ordered that no court fee be charged and that the expenses be borne by the State. Where the appointed lawyer submits a fee note for assessment, the deciding court may tax the remuneration by formal order and fix the amount including VAT. In the same order it may waive the justice fee and place expenses at the charge of the State. The order on the amount of the honorarium is subject to appeal by the counsel and the competent department within the prescribed time-limit (consid. 1-3).
