letti ed esaminati gli atti;

richiamata la petizione 3 ottobre 2001 con cui la __________ ha chiesto al TCA di condannare la Fondazione __________ al versamento di fr. 15'954.35 oltre interessi al 5% a far tempo dal 21 febbraio 2001, a titolo di contributi previdenziali relativi agli anni 1999 e 2000, postulando altresì il rigetto dell'opposizione interposta al PE n. __________del 15 maggio 2001 dell'UE di __________;

vista la risposta di causa 12 novembre 2001;

visto lo scritto 17 gennaio 2002 con cui la Fondazione convenuta ha dichiarato di aderire incondizionatamente alla richiesta di parte attrice;

considerato che il riconoscimento della pretesa di cui allo scritto 17 gennaio 2002 della convenuta configura atto di acquiescenza la quale pone fine alla lite con effetto di cosa giudicata materiale;

ritenuto che alla Cassa attrice, rappresentata da un avvocato, ancorché vittoriosa, non possono essere assegnate indennità di patrocinio (SZS 2001 pag. 174; DTF 112 V 356, STCA del 9 marzo 1992 in re F.P. c/S. SA; per le eccezioni cfr. DTF 112 V 362; RAMI 1992 pag. 164).

in applicazione degli art. 23 LPTCA, art. 352 cpv. 1 e 2 CPC;

decreta 1. la petizione è stralciata dai ruoli per acquiescenza.

§ E' rigettata in via definitiva l'opposizione interposta al precetto esecutivo no. __________dell'UE di __________ del 15 maggio 2001 per l'importo di fr. 15'954.35 oltre interessi al 5% a far tempo dal 21 febbraio 2001;

  1. non si prelevano né tasse né spese;

  2. intimazione alle parti a sensi ed effetti di legge.
