considerato, in fatto ed in diritto
A. Il 16 aprile 2004 __________ __________ ha inoltrato ricorso contro la decisione 12 marzo 2004 con cui ___________ gli ha inflitto una multa di fr. 200.-, oltre la tassa di giustizia di fr. 40.- e le spese di fr. 20.-, per aver circolato con il veicolo __________ __________avente 2 copertoni privi di sufficienti rilievi antiscivolanti.
B. Si rileva che la menzionata decisione, intimata regolarmente, non è stata ritirata dal ricorrente ed è rimasta in giacenza presso l'ufficio postale di __________ fino al 29 marzo 2004. Per il computo del termine di ricorso fa stato l'ultimo giorno di giacenza della raccomandata; ne consegue che il termine perentorio di 15 giorni per la presentazione del ricorso, ai sensi degli art. 4 cpv. 2 e 7 cpv. 5 LPContr, è scaduto infruttuosamente.
Il fatto asserito dal ricorrente secondo cui egli era assente per vacanze nulla muta al riguardo.
Pertanto il ricorso è tardivo e deve essere dichiarato irricevibile.
C. Visto l'esito del gravame non si può prescindere dall'applicazione di una modica tassa di giustizia (art. 15 LPContr).
Per questi motivi, visti gli artt. 4, 7, 15 LPContr;
dichiara e
pronuncia: 1. Il ricorso 16 aprile 2004 inoltrato da __________ è irricevibile.
La tassa di giustizia e le spese di fr. 50.- sono a carico del ricorrente.
