ritenuto, in fatto ed in diritto

A. Con lettera - peraltro non firmata - 10 dicembre 2003, ma spedita il 12 dicembre 2003, __________ __________ ha inoltrato ricorso contro la decisione 14 novembre 2003 con cui la Sezione della circolazione gli ha inflitto una multa di fr. 200.-, oltre la tassa di giustizia di fr. 40.- e le spese di fr. 20.-, per aver guidato un autofurgone trasportante un carico non convenientemente assicurato che di conseguenza si è riversato in parte sul campo stradale.

Nel ricorso __________ __________ ha asserito tra l'altro di non poter pagare la multa in quanto ha stipendi arretrati dal mese di giugno.

B. Si rileva che la menzionata decisione, intimata regolarmente, non è stata ritirata dal ricorrente ed è rimasta in giacenza presso l'ufficio postale di __________ fino al 24 novembre 2003. Per il computo del termine di ricorso fa stato l'ultimo giorno di giacenza della raccomandata; ne consegue che il termine perentorio di 15 giorni per la presentazione del ricorso, ai sensi degli art. 4 cpv. 2 e 7 cpv. 5 LPContr, è scaduto infruttuosamente.

Pertanto il ricorso deve essere dichiarato irricevibile.

C. Vista la particolarità del caso si prescinde dal prelevare tasse e spese in questa sede.

Un'eventuale richiesta di rateazione della multa va presentata tempestivamente all'Ufficio esazione e condoni.

Per questi motivi, visti gli artt. 4, 7, 15 LPContr;
