richiamato il decreto DAP / del __________ 2001, mediante il quale gli è stata inflitta una multa di fr. 1'200.--;
rilevato che la multa è stata pagata solo in ragione di fr. 600.-- e che ogni tentativo di incasso del residuo è risultato infruttuoso;
considerato pertanto che occorre procedere alla commutazione della multa inflitta, in ragione di un giorno di arresto ogni fr. 30.-- di multa, ma al massimo novanta giorni;
richiamati gli art. 49 cifra 3 CP e 347 CPP,
pronuncia 1. L'istanza del Ministero Pubblico __________ di commutazione della multa in arresto è accolta.
