in fatto e in diritto: che con istanza 7 maggio 1999 __________ ha chiesto il rigetto in via definitiva dell’opposizione interposta da __________ al PE no__________ dell’UEF di Mendrisio notificatole per l’incasso di fr. 150.- pari alle ripetibili riconosciute all’istante con sentenza 29 maggio 1998 del Segretario assessore della Pretura del distretto di Lugano, sezione 2 (doc. A);

che con sentenza 11 giugno 1999 il Giudice di pace del circolo di Mendrisio, accertata la presenza agli atti di un valido titolo esecutivo, ha accolto l’istanza;

che con scritto 16 giugno 1999, indirizzato alla Pretura di Lugano sezione 4, __________ ha manifestato di volersi opporre al pagamento dell’importo posto in esecuzione chiedendo nel petitum che venisse dichiarata “l’inesistenza del debito al precetto, con opposizione del 23-1-1199 allegato N. __________”;

che la Pretura ha trasmesso a questa Camera lo scritto in questione ritenendolo un ricorso per cassazione;

che dalla domanda di giudizio si evince che __________ non intende ricorrere contro la sentenza del Giudice di pace;

che di conseguenza lo scritto 16 giugno 1999 va ritornato alla Pretura del distretto di Lugano, sezione 4 alla quale era stato originariamente indirizzato, affinché abbia ad occuparsi del medesimo.

Per i quali motivi,

pronuncia:

  1. Lo scritto 16 giugno 1999 __________ viene ritornato - con l’incarto - alla Pretura del distretto di Lugano, sezione 4, ai sensi dei considerandi.

  2. Il presente giudizio è esente da tasse e spese.
