la decisione 27 agosto 1998 del ___________ - ___________, ___________, __________ con la quale viene ordinato il rimpatrio del ricorrente con l’obbligo di abbandonare il territorio del Canton Ticino entro il 13 novembre 1998.

Ritenuto che la Camera di cassazione civile, investita dalla questione dal ricorrente,

non è autorità competente a giudicare in materia mentre lo è, come espressamente

indicato nella stessa decisione impugnata, il Consiglio di Stato;

atteso che, per l’art. 126 CPC, quando un atto è presentato a un’autorità giudiziaria

incompetente, questa lo trasmette subito, d’ufficio, all’autorità competente e ne dà

comunicazione alla parte che lo ha inoltrato

pronuncia:
