Summary

The Civil Cassation Chamber of the Ticino Court of Appeal held that the appeal had been filed before an incompetent judicial authority because, for value-based jurisdiction reasons, it should have been addressed to the Second Civil Chamber. Ritenuto che per ragione di competenza “ratione valoris” il ricorso avrebbe dovuto

essere indirizzato alla Seconda Camera civile del Tribunale di appello.

Considerato che quando un atto è indirizzato ad un’Autorità giudiziaria incompetente, quest’ultima è tenuta a trasmetterlo d’ufficio a quella competente.

Richiamati al proposito gli art. 8 e 126 CPC,
