Viste le osservazioni 13 ottobre 2004 dell’CO 1

esaminati atti e documenti;

ritenuto in fatto e considerato in diritto:

che la PI 1 procede nei confronti della RI 1 per l’incasso del proprio credito;

che il 28 settembre 2004 veniva notificato alla presidente del consiglio di amministrazione dell’escussa l’avviso di pignoramento nell’esecuzione n. __________ promossa nei suoi confronti dalla creditrice;

che con ricorso 4 ottobre 2004 la RI 1 si aggrava contro la notifica dell’avviso di pignoramento, sostenendo che la stessa sarebbe nulla essendo avvenuta all’indirizzo sbagliato;

che delle osservazioni dell’CO 1 si dirà, se del caso, in seguito;

che per l’art. 90 LEF il debitore deve essere avvisato del pignoramento almeno il giorno prima;

che, secondo la dottrina un pignoramento non correttamente notificato non è nullo, ma unicamente annullabile (cfr. André E. Lebrecht, Basler Kommentar zum SchKG, Basilea/Ginevra/ Monaco 1998, n. 15 ad art. 90 );

che tuttavia un pignoramento può essere annullato unicamente nel caso in cui a causa di un’errata o ritardata notifica il debitore non ha potuto presenziare al pignoramento o non ha potuto fare valere i propri diritti (cfr. André E. Lebrecht, op. cit., n. 16 ad art. 90);

che nel caso di specie la ricorrente si duole del fatto che l’avviso di pignoramento è stato inviato a __________, dove la società escussa non ha alcun recapito e neppure risulta domiciliata la presidente del consiglio di amministrazione;

che tuttavia a prescindere dal luogo in cui è stato notificato l’avviso di pignoramento, lo stesso risulta essere pervenuto all’escussa, prova ne è il presente gravame;

che di conseguenza la ricorrente ha avuto notizia del pignoramento, previsto per il 22 ottobre 2004, almeno il 4 ottobre 2004 e quindi ben prima del termine previsto dall’art. 90 LEF;

che il ricorso va pertanto respinto;

che non si preleva la tassa di giustizia e non si assegnano indennità (art. 61 cpv. 2 lett. a, e 62 cpv. 2 OTLEF).

Richiamati gli art. 17, 20a, 90 LEF; 61, 62 OTLEF;

pronuncia:

  1. Il ricorso 4 ottobre 2004 di RI 1, , è respinto.

  2. Non si prelevano spese, né si assegnano indennità.

  3. Contro questa decisione è dato ricorso entro dieci giorni alla Camera delle esecuzioni e dei fallimenti del Tribunale federale a Losanna, per il tramite della scrivente Camera di esecuzione e fallimenti del Tribunale d’appello, in conformità dell’art. 19 LEF.
