Summary

The Cantonal enforcement and bankruptcy chamber, sitting as supervisory authority, dealt with a complaint against the Leventina enforcement office for alleged delayed justice. Before the court ruled, the complainant withdrew the complaint in writing on 11 August 1995. The chamber therefore held that the matter had become moot and ordered the case struck from the docket. It also decided that no costs would be charged and no indemnity would be granted.

OTLEF art. 67 cpv. 2 and art. 68 cpv. 2; withdrawal of a supervisory complaint and procedural consequences: if the complainant withdraws the complaint before judgment, the matter becomes devoid of object and is struck from the roll. In such a case, absent special circumstances, no court costs are levied and no indemnity is awarded.
