sulla quale istanza la Pretore __________, con sentenza 2 marzo 2006 ha così deciso:

“1. È pronunciato il fallimento della AP 1, __________, a far tempo

da giovedì 2 marzo 2006 alle ore 14.00.

2./3./4. Omissis.”

Sentenza dedotta tempestivamente in appello dalla AP 1 che con atto

7 marzo 2006 ne postula l’annullamento;

preso atto che la parte appellata non ha presentato osservazioni;

rilevato che - pendente il presente gravame - questa Camera con decisione

6 aprile 2006 ha respinto un precedente appello inoltrato dalla AP 1

contro un decreto di fallimento pronunciato il 20 febbraio 2006 dalla Segretaria

Assessore__________, (inc. EF.__________), dichiarando

il fallimento della AP 1 per il giorno di venerdì 7 aprile 2006

alle ore 14.00 e che questa decisione è rimasta inimpugnata;

considerato come la presente procedura sia così divenuta priva d’oggetto, per cui

va stralciata dai ruoli;

rilevato che per principio giurisprudenziale indiscusso, la parte che rende

priva d’oggetto una procedura risulta soccombente ai fini del giudizio su spese

e indennità (DTF 113 III 110 cons. 3a), per cui la tassa di giustizia va caricata alla

AP 1, mentre non si assegnano indennità, la parte appellata non

avendo presentato osservazioni;

pronuncia:

  1. L’appello 7 marzo 2006 di AP 1, __________, è stralciato dai ruoli.

  2. La tassa di giustizia di fr. 50.-- del presente giudizio, già anticipata dalla AP 1, resta a suo carico.

Non si assegnano indennità.
