istanza ammessa dal __________ che il 21 dicembre 2005 ha ordinato all'Ufficio esecuzione __________ di procedere all'inventario di tutti i beni della convenuta;

sentenza dedotta in appello il 5 gennaio 2006 daAP 1che ha chiesto la reiezione della domanda d'inventario, protestate tasse, spese e ripetibili;

ritenuto che a seguito di questa sentenza rimasta inimpugnata, sia la decisione con cui è stato ordinato l¿inventario preventivo di cui agli art. 183 e 162 LEF che lo stesso inventario sono decaduti per legge, non essendone più realizzate le condizioni per l¿allestimento;

preso atto che il presente appello (contro la sentenza 21 dicembre 2005 del __________) è così divenuto privo d¿oggetto, per cui va stralciato dai ruoli;

rilevato che per principio giurisprudenziale indiscusso, la parte che ha causato la carenza d¿oggetto di una procedura è considerata soccombente ai fini del giudizio su spese e indennità (DTF 113 III 110 cons. 3a);

ritenuto che in concreto la procedura è divenuta priva d¿oggetto a seguito dell¿accoglimento di un¿impugnazione presentata in altra procedura, di cui l¿appellante non ha tuttavia rilevato gli effetti sul presente appello, almeno dopo il 2 febbraio 2006;

considerato che il contenuto delle osservazioni 27 gennaio 2006 di Ambata SA non giustifica l¿assegnazione di indennità all¿appellata;

pronuncia:

  1. L'appello 5 gennaio 2006 diAP 1, __________è stralciato dai ruoli.

  2. La tassa di giustizia di fr. 150.-, anticipata dall¿appellante, resta a suo carico. Non si assegnano indennità.
