statuendo sulla causa a procedura sommaria appellabile (riconoscimento di fallimento estero) promossa con istanza 16 dicembre 1996 da

IS1 rappr. dal curatore del fallimento, RA1 rappr. dall' RA2

e ora sull'istanza 5 marzo 2004 tendente alla revoca del fallimento secondario pronunciato da questa Camera il 6 giugno 2000 (inc. 14.00.21) in particolare nei confronti di

CO1

ritenuto in fatto e considerando in diritto:

che con sentenza 15 maggio 1996 il Tribunale di Napoli (Italia) ha dichiarato il fallimento di __________, società di fatto con sede a Napoli, e di __________, Napoli, soci illimitatamente responsabili della __________;

che con sentenza 10 luglio 1996 – resa, su "ricorsi per estensione di fallimento" del 17 e 22 maggio 1996, "per estensione del fallimento della società di fatto __________, dichiarato da questo Tribunale con sentenza del 16 [recte: 15] maggio 1996" – lo stesso Tribunale di Napoli ha dichiarato il fallimento di __________, __________, __________ e __________ CO1, Napoli;

che con sentenza 6 giugno 2000 (inc. 14.2000.21), questa Camera ha riconosciuto in Svizzera tutti i fallimenti decretati il 15 maggio 1996 e il 10 luglio 1996;

che con sentenza 16 ottobre 2002 (cfr. doc. H allegato all'istanza, ultima pagina), depositata il 13 dicembre 2002, il Tribunale di Napoli, settima sezione civile, ha respinto le opposizioni al fallimento interposte da __________ e __________, accogliendo invece quelle di __________ CO1 e __________ e revocando il fallimento di queste ultime;

che il curatore fallimentare, con atto 10 dicembre 2003, ha rinunciato ad appellare tale sentenza (cfr. doc. H, a.i.);

che ora l'istante, preliminarmente al riconoscimento ex art. 173 LDIP della graduatoria (stato passivo) depositata al Tribunale di Napoli il 18 dicembre 1996/29 gennaio 1997 (inc. 14.03.99/ 04.27), chiede la revoca del fallimento secondario di __________ CO1;

che l'istanza va accolta;

che le spese, determinate in base all'art. 30 LTG siccome la procedura è regolata dalla legge di procedura civile cantonale (cfr. art. 513 al. 2 CPC), vanno messe a carico di chi le ha causate (cfr. art. 148 cpv. 3 CPC), ossia a carico della massa fallimentare;

Per questi motivi,

richiamati gli l’art. 166 ss. LDIP; 513 CPC; 30 LTG;

pronuncia:

  1. Il fallimento secondario decretato il 6 giugno 2000 (inc. 14.2000.21) nei confronti di __________ CO1 è revocato.

  2. È ordinata la pubblicazione del dispositivo n. 1 sul FUSC e sul FUC.

  3. La tassa di giustizia di fr. 1'000.-- e le spese di pubblicazione sul FUSC e sul FUC sono poste a carico dell'AP1. Non si assegnano ripetibili.

  4. Intimazione a:

– Ufficio fallimenti di Lugano, Lugano
