tendente a ottenere il rigetto definitivo dell'opposizione interposta al PE n. __________

del 27/28 ottobre 2003 dell'UE di Lugano;

sulla quale istanza la Pretore del Distretto di Lugano, Sezione 5, con sentenza

16 febbraio 2004 ha così deciso

"1. L'istanza è accolta e di conseguenza l'opposizione interposta al summenzionato precetto esecutivo è respinta in via definitiva.

  1. La tassa di giustizia in fr. 160.-, da anticipare dalla parte istante, è posta a carico della parte convenuta con l'obbligo di rifondere a controparte fr. 280.- a titolo di indennità";

visto lo scritto 18 febbraio 2004 inviato dall'escusso alla Pretore, ritenuto in un primo tempo come impugnazione della menzionata sentenza;

preso atto che l'istante non ha presentato osservazioni;

ritenuto

in fatto e in diritto:

che, in virtù dei combinati art. 25 LALEF e 309 CPC, dev'essere considerato appello soltanto la tempestiva impugnazione di una decisione pretorile che, tra l'altro, contenga la dichiarazione di appellare con l'indicazione precisa dei punti della sentenza impugnata che si intendono dedurre dinanzi alla seconda istanza;

che lo scritto citato, trasmesso dalla Pretura a questa Camera, non esprime nemmeno la volontà della parte di appellare (Cocchi/ Trezzini, CPC-TI, art. 309, m. 6), ossia di ottenere dall'istanza superiore un giudizio a lei favorevole, tant'è che essa -pur non condividendo le conclusioni del primo giudice- afferma testualmente di voler ossequiare lo stesso giudizio;

che non v'è pertanto ragione per decidere alcunché in assenza di gravame, dovendo così stralciare la procedura d'appello per mancanza d'oggetto (art. 351 cpv. 1 CPC per analogia);

decreta:

  1. L'atto 18 febbraio 2004 (di cui ai considerandi) è stralciato dai ruoli.

  2. Non si prelevano spese né tassa di giustizia.

  3. Intimazione: - __________
