sulla quale istanza la Pretore del __________ con sentenza 15 ottobre 2004 ha così deciso:

“1. È pronunciato il fallimento di __________ RI 1, __________, a far tempo da venerdì

15 ottobre 2004 alle ore 14.00.

2./3./4. Omissis.”

Sentenza dedotta tempestivamente in appello da __________ RI 1 che con atto

20 ottobre 2004 ne postula l’annullamento;

rilevato che con ordinanza presidenziale 25/26 ottobre 2004 all’appello è

stato concesso effetto sospensivo parziale;

preso atto che con provvedimento 1. dicembre 2004 l’__________ __________

ha annullato nell’esecuzione in oggetto n. 1024216 la comminatoria di fallimento,

ritenuto che per una svista dovuta ad un caso di omonimìa la procedura non

doveva proseguire in via di fallimento, bensì in via di pignoramento;

considerato che essendo stata annullata la comminatoria, il fallimento di

__________ RI 1 va pure annullato (art. 166 e 172 LEF);

ritenuto che per le peculiarità del caso si prescinde dal prelevare la tassa di giustizia

in ambo le sedi, mentre le spese dell’Ufficio fallimenti vanno poste a carico dello Stato

e che non si assegnano indennità, non avendo la parte appellata presentato

osservazioni;

pronuncia:

I. L’appello 20 ottobre 2004 di __________ RI 1 __________ è accolto.

“1. La dichiarazione di fallimento 15 ottobre 2004 pronunciata dalla __________, , inc. EF. nei confronti di __________ RI 1, __________, è annullata.

  1. Non si preleva la tassa di giustizia di prima sede.

  2. Le spese dell’Ufficio __________, da anticipare come di rito, sono poste a carico dello Stato del Canton Ticino.
