statuendo sulla causa a procedura sommaria appellabile promossa con istanza 6 agosto 2003 da

AO0 patr. dall' RA0,

contro

AP0 patrocinata da PA0

tendente ad ottenere il rigetto provvisorio dell’opposizione interposta al PE n. __________ del 22 maggio/21 luglio 2003 dell’UEF di Bellinzona;

sulla quale istanza il Segretario assessore della Pretura di Bellinzona con sentenza 11 settembre 2003 ha così deciso:

“1. È rigettata in via provvisoria per la somma di fr. 8'890.-- oltre interessi al 5% dal 16 maggio 2003 l’opposizione interposta al precetto esecutivo n. __________dell’UEF di Bellinzona, notificato il 21 luglio 2003.

La tassa di giustizia e le spese di complessivi fr. 130.--, da anticipare dall’istante, sono a carico della convenuta, la quale rifonderà alla controparte fr. 50.-- per ripetibili”.

Contro la sentenza pretorile si è tempestivamente aggravata l'escussa che con atto 19 settembre 2003 ha postulato l'integrale reiezione dell'istanza, protestate spese e ripetibili;

rilevato che con osservazioni 10 ottobre 2003 la parte appellata si è opposta al gravame, con protesta di spese e ripetibili;

preso atto che con scritto 22 ottobre 2003 __________ ha ritirato l’atto di appello del 19 settembre 2003;

considerato che il ritiro dell’appellazione è avvenuto dopo che l’appellato ha presentato le proprie osservazioni e che pertanto vi è la necessità di assegnare un’indennità ex art. 62 OTLEF, ritenuto che per principio giurisprudenziale indiscusso, la parte che rende priva d’oggetto una procedura risulta soccombente ai fini del giudizio su spese e indennità (DTF 113 III 110 cons. 3a);

decreta:

  1. L’appello 19 settembre 2003 di __________ o, è stralciato dai ruoli per intervenuto ritiro.

  2. La tassa di giustizia di fr. 100.--, già anticipata dall’appellante, resta a carico di __________. La parte eccedente dell’anticipo, pari a fr. 95.--, è restituita all’appellante. __________ rifonderà a __________ fr. 250.-- a titolo di indennità.

  3. Intimazione a:
