statuendo sulla causa a procedura sommaria appellabile __________ promossa con istanza 5 febbraio 2003 da


contro


tendente ad ottenere il rigetto dell’opposizione interposta dal Municipio di __________ al precetto esecutivo n. __________ dell’UE di Lugano notificato il 29 gennaio 2002 per il pagamento di fr. 37'235,80 oltre interessi e spese;

vista la sentenza 3 aprile 2003 della Segretaria Assessore della Pretura di Lugano, Sezione 5, che ha respinto la suddetta istanza;

preso atto dell’appello 8 aprile 2003 dell’arch. __________;

atteso che esso non è stato notificato alla controparte, in quanto i propri diritti non sono pregiudicati dalla presente procedura;

ritenuto in fatto e considerando in diritto:

che l’appellante allega di non essere stato citato all’udienza di contraddittorio del 3 aprile 2003 e chiede l’annullamento della tassa di giustizia di fr. 210.-- che gli è stata accollata con la sentenza impugnata;

che la Pretura di Lugano ha confermato la mancata citazione dell’appellante in seguito ad un disguido di cancelleria;

che l’udienza 3 aprile 2003 e la consecutiva sentenza di stessa data risultano pertanto nulle (art. 142 cpv. 1 lett. b CPC per il rinvio dell’art. 25 LALEF), ciò che va rilevato d’ufficio da ogni autorità, compresa quella che ha emanato l’atto di procedura nullo;

che anche il dispositivo riferito alla tassa di giustizia risulta pertanto nullo;

che siccome la nullità è da addebitare alla Pretura di Lugano, occorre prescindere dal prelevare la tassa di giustizia, sia di prima che di seconda istanza;

che non occorre ordinare la fissazione di una nuova udienza, avendo l’appellante nel frattempo ritirato l’esecuzione in seguito ad un accordo con il Comune di __________;

che l’appello va quindi accolto;

che non si assegnano indennità in quanto non richieste dall’appellante.

Richiamati gli art. 82 LEF; 142 CPC; 25 LALEF; 61, 62 OTLEF;

pronuncia:

  1. L’appello 8 aprile 2003 dell’arch. __________ è accolto.

1.1. Di conseguenza, la sentenza emanata il 3 aprile 2003 dalla Segretaria assessore della Pretura del Distretto di Lugano, Sezione 5, nella procedura __________ è dichiarata nulla.

  1. Non si preleva la tassa di giustizia e non si assegnano indennità.
