tendente ad ottenere il rigetto provvisorio dell'opposizione interposta al PE n. __________ del 21/25 gennaio 1999 dell'UE di Lugano;

sulla quale istanza la Segretaria assessore della Pretura del Distretto di Lugano, Sezione 5, con sentenza 15 marzo 1999 ha così deciso:

"1. L'istanza è accolta e di conseguenza l'opposizione interposta al summenzionato precetto esecutivo è respinta in via provvisoria.

  1. La tassa di giustizia in fr. 400.--, da anticipare dalla parte istante, è posta a carico della parte convenuta, con l'obbligo di rifondere a controparte fr. 4'000.-- a titolo di indennità."

Sentenza dedotta tempestivamente in appello dall'escusso che con atto 26 marzo 1999 ha postulato la reiezione dell'istanza, con protesta di spese e ripetibili;

con osservazioni 30 aprile 1999 la parte appellata si è opposta al gravame, protestate spese e ripetibili;

preso atto che con scritto 12 novembre 1999 il __________ ha chiesto all'UE di Lugano l'annullamento dell'esecuzione in esame n. __________;

considerato come la procedura sia così divenuta priva d'oggetto;

ritenuto che per principio giurisprudenziale indiscusso, la parte che rende priva d'oggetto una procedura risulta soccombente ai fini del giudizio su spese e indennità (DTF 113 III 110 cons. 3a), eccezione fatta nell'evenienza in cui le parti ne concordino un diverso riparto;

considerato che le parti non hanno comunicato accordo alcuno;

pronuncia

L'appello 26 marzo 1999 di __________, è stralciato dai ruoli.

  1. La tassa di giustizia di fr. 200.--, già anticipata dall'appellante, è posta a carico del __________, che rifonderà a __________ fr. 1'000.-- a titolo di indennità.
