tendente ad ottenere il rigetto provvisorio dell’opposizione interposta al PE n. __________ del 13/15 ottobre 1998 dell’UE di Lugano;

sulla quale istanza la Pretore del Distretto di Lugano, Sezione 5, con sentenza 26 novembre 1998 ha così deciso:

“1. L’istanza è respinta.

  1. La tassa di giustizia in fr. 270.--, da anticipare dalla parte istante, è posta a suo carico, con l’obbligo di rifondere alla controparte fr. 1’000.-- a titolo di indennità.”

Contro la sentenza pretorile si è tempestivamente aggravata la procedente che con atto 10 dicembre 1998 ha postulato l’accoglimento dell’istanza, protestate spese e ripetibili;

rilevato che con osservazioni 8 gennaio 1999 la parte appellata si è opposta al gravame, con protesta di spese e ripetibili;

preso atto che con decreto 24 settembre 1999 la Pretura del Distretto di Lugano

ha pronunciato il fallimento della __________;

ritenuto che ex art. 206 cpv. 1 LEF tutte le esecuzioni in corso contro la fallita

cessano di diritto durante la procedura di fallimento;

preso atto che la procedura di fallimento è stata nel frattempo chiusa e che la


è stata cancellata d'ufficio dal Registro di commercio il 7 marzo 2003;

considerato come la procedura d'appello sia così divenuta priva d'oggetto, per cui

va stralciata dai ruoli;

ritenuto che malgrado la soccombenza, essendo __________ stata cancellata

dal Registro di commercio il 7 marzo 2003, la stessa non può più essere condannata al pagamento della tassa di giustizia e alla rifusione di ripetibili a controparte

pronuncia:

  1. L'appello 10 dicembre 1998 __________ è stralciato dai ruoli.

  2. La tassa di giustizia di fr. 50.--, resta a carica di chi l’ha anticipata. A __________ saranno retrocessi fr. 350.--versati in eccedenza. Non si assegnano indennità.

  3. Intimazione: - __________
