Omnilex summary

The appellant withdrew its appeal against a first-instance ruling on definitive removal of objection in debt enforcement proceedings. The appellate court noted that the withdrawal made the appeal moot and ordered it struck from the docket. Applying the settled rule that the party causing the proceedings to become moot is treated as unsuccessful for costs purposes, and because no different cost agreement between the parties was reported, the court charged the CHF 50 court fee to the appellant and denied any indemnity.

Omnilex headnote

Withdrawn appeal; mootness and costs allocation. When an appellant withdraws an appeal, the appellate proceedings become moot and the matter is struck from the docket (consid. 1). For costs and party indemnity, the party who renders the proceedings moot is deemed unsuccessful; costs are borne by that party unless the parties have agreed on a different allocation (consid. 2; cf. DTF 113 III 110 consid. 3a).

contro

tendente ad ottenere il rigetto definitivo dell’opposizione interposta al PE n. __________ del __________ 1996 dell’UE di __________;

Sentenza dedotta tempestivamente in appello dallo __________ che con atto 16 aprile 1997 ha postulato l'accoglimento dell'istanza, protestate spese e ripetibili;

la parte appellata non ha prodotto osservazioni;

preso atto che con scritto 28 aprile 1998 l'appellante ha dichiarato di ritirare l'appello;

considerato che il ritiro dell'appello ne comporta lo stralcio essendo la procedura divenuta priva di oggetto;

ritenuto che, per principio giurisprudenziale indiscusso, la parte che rende priva di oggetto una procedura risulta soccombente ai fini del giudizio su spese e indennità (DTF 113 III 110 cons. 3a), eccezione fatta nell'evenienza in cui le parti ne concordino un diverso riparto;

rilevato che, non avendo le parti comunicato alcun accordo in merito alle spese, queste vanno caricate all'appellante;

pronuncia

  1. L’appello 16 aprile 1997 __________ è stralciato dai ruoli per intervenuto ritiro.

  2. La tassa di giustizia di fr. 50.--, già anticipata dall’appellante, è posta a suo carico, non si asssegnano indennità.
