Richiamata la diffida 11 luglio 1996 del presidente di questa Camera mediante la quale alla ricorrente veniva assegnato un termine scadente il 29 luglio 1996 per effettuare sul c.c.p. 69-10370-9 del Tribunale d’appello -introiti AGITI- un deposito di fr. 600.-- a titolo di anticipo per le presunte spese giudiziarie, con la comminatoria che, in caso di mancato versamento dell'importo entro il termine fissato, il ricorso sarebbe stato dichiarato deserto ai sensi dell'art. 312 CPC;

ritenuto che in materia di rigetto dell’opposizione le ferie non sospendono i termini;

considerato come -di conseguenza- il versamento, effettuato solo il 13 agosto1996,

sia -ritenuta la perentorietà del termine stesso- da considerarsi tardivo,

decreta 1. L'appello 5 luglio 1996 della __________, Filiale di __________ , avverso la decisione 25 giugno 1996 del Segretario assessore della Pretura di Lugano, è stralciato dai ruoli per versamento tardivo dell'anticipo.

  1. Le spese del presente giudizio con tassa di giustizia per complessivi fr.100.-- sono poste a carico dell'appellante.
