tendente ad ottenere il rigetto provvisorio dell’opposizione interposta al PE n. __________ del 16/26 giugno 1995 dell’UEF di Locarno;

sulla quale istanza il Pretore di Locarno-Città con sentenza 9/10 ottobre 1995 ha così deciso:

“1. L’istanza è accolta.

Di conseguenza è rigettata in via provvisoria l’opposizione interposta dal convenuto __________ al precetto esecutivo n. __________dell’UEF di Locarno per l’importo di Fr. 48’000.-- oltre Fr. 98.-- di spese esecutive.

  1. Le spese e la tassa di giustizia per complessivi Fr. 50.-- sono poste a carico del convenuto, che rifonderà inoltre all’istante Fr.100.-- di indennità.”

Sentenza dedotta tempestivamente in appello da __________ che con atto 23 ottobre 1995 ha chiesto l’ammissione di documenti risp. l’annullamento della sentenza pretorile ed in via subordinata la reiezione dell’istanza, protestate spese e ripetibili,

rilevato che con scritto 8 novembre 1995 l’appellante ha chiesto la sospensione della procedura;

preso atto che con scritto 25 giugno 1998 __________ ha ritirato l’appello;

considerato come il ritiro dell’appello ne comporta lo stralcio siccome la procedura è divenuta priva d’oggetto;

ritenuto che per principio giurisprudenziale indiscusso, la parte che rende priva d’oggetto una procedura risulta soccombente ai fini del giudizio su spese e indennità (DTF 113 III 110 cons. 3a), eccezione fatta nell’evenienza in cui le parti ne concordino un diverso riparto;

preso atto che non avendo le parti comunicato alcun accordo in merito alle spese, la tassa di giustizia va posta a carico dell’appellante, mentre non si assegnano indennità, in mancanza di un petitum in tal senso, la parte appellata non avendo presentato osservazioni (art. 48, 49, 61 cpv. 1 e 62 cpv. 1 OTLEF);

pronuncia: 1. L’appello 23 ottobre 1995 di __________, è stralciato dai ruoli per intervenuto ritiro.

  1. La tassa di giustizia di Fr. 40.--, già anticipata dall’appellante, resta a carico di __________.
