che il Segretario assessore della Pretura, con sentenza 23 novembre 2005, ha parzialmente accolto, condannando il solo convenuto AP 1 a versare all¿attore l¿importo di Fr. 170'100.- oltre interessi al 5% dal 20 novembre 1998.

Appellante il convenuto AP 1 il quale, con atto d¿appello14 dicembre 2005, ha chiesto la riforma del primo giudizio nel senso di respingere integralmente la petizione.

Sospesa la procedura d¿appello, con ordinanza 22 dicembre 2005, essendo in corso tra le parti trattative per la definizione bonaria della controversia.

Visto lo scritto 30 marzo 2006 del patrocinatore dell¿appellante che comunica che ¿tra le parti è stata trovata una soluzione bonale che permette lo stralcio puro e semplice della procedura d¿appello¿.

Considerato che le spese, ridotte ai minimi tariffali visto l¿esito della procedura, sono a carico dell¿appellante mentre non si assegnano ripetibili alla controparte che, stante l¿intervenuta sospensione della procedura, non è stata chiamata a presentare osservazioni all¿appello.
