che il Pretore, con decreto 24 giugno 2004, ha accolto ordinando ai convenuti di sgomberare immediatamente l'appartamento al II° piano, interno n. 5, dello stabile sito in via __________ __________ 1 a __________.

Appellanti i convenuti i quali, con scritto 1 luglio 2004, chiedono "l'effetto sospensivo della decisione, in quanto stiamo avendo difficoltà a trovare un nuovo appartamento".

Letti ed esaminati gli atti dell'incarto

Considerato

in fatto ed in diritto

che il decreto di sfratto trova giustificazione nella disdetta 11 febbraio 2004, data dagli inquilini , con effetto 31 marzo 2004 e accettata dagli istanti, del contratto di locazione stipulato il 17 aprile 2001 e riguardante l'appartamento al II° piano, interno n. 5, dello stabile sito in via __________ __________ 1 a __________;

che con l'appello i convenuti non contestano la decisione di sfratto del Pretore ma, in definitiva, chiedono una proroga del termine per uscire dall'appartamento trovando difficoltà nella ricerca di una nuova sistemazione;

che il differimento dell'esecuzione dello sfratto non è previsto dalla nostra legislazione ed il termine per l'abbandono fissato dal giudice ha natura meramente ordinatoria e non può formare oggetto di impugnativa (Cocchi/Trezzini, CPC-TI, ad art. 508

m. 9);

che, eventualmente, spetta all'autorità d'esecuzione dello sfratto la possibilità di concedere un termine di moratoria di breve durata sempre che ciò sia giustificato da elementari ragioni di umanità (Droit du bail, 1991 n. 29), ciò che non appare nel caso concreto avendo, del resto, gli inquilini rescisso il contratto ed avendo potuto continuare ad occupare l'appartamento per alcuni mesi dopo la scadenza del contratto;

  1. L'appello 1 luglio 2004 di __________ e __________ APPE1 è respinto.

  2. Non si prelevano tasse o spese di giudizio.
