intesa ad assumere, quale prova a futura memoria ai sensi degli art. 446 e seg. CPC, la deposizione testimoniale del signor __________ che il Pretore, con decreto 19 dicembre 2003, ha accolto.

Appellanti i convenuti, i quali, con atto d'appello 29 dicembre 2003, chiedono la riforma del primo giudizio nel senso di respingere l'istanza a futura a memoria.

Letti ed esaminati gli atti della causa.

Considerato

in fatto ed in diritto

che l'art. 451 CPC prevede che i decreti che ammettono la prova a futura memoria sono inappellabili;

che, di conseguenza, l'appello in questione, che si aggrava contro una decisione del Pretore che ammette la prova a futuro, è irricevibile e come tale può essere deciso già all'esame preliminare dell'art. 313bis CPC, senza necessità di intimazione alla controparte;

che l'appello, come intendono i ricorrenti, non può nemmeno essere considerato formulato a titolo prudenziale ai sensi dell'art. 96 CPC e trattato con la prima appellazione sospensiva della causa di merito che eventualmente seguirà l'assunzione della prova a futuro;

che, infatti, la procedura di prova a futura memoria e quella di merito, come appare dalla sistematica della legge, sono due procedure ben distinte ed indipendenti tra loro (Cocchi/Trezzini, CPC-TI, ad art. 446 m. 5), e ciò sia quando la prova a futuro è chiesta prima che quando lo è pendente la causa di merito;

che la parte appellante sopporta la tassa e le spese di giudizio mentre non sono assegnate ripetibili alla controparte che non ha dovuto esprimersi sull'appello;

Per i quali motivi

visti gli art. 446 e seg. CPC

e, per le spese, la vigente TG

dichiara e pronuncia

  1. L'appello 29 dicembre 2003 è irricevibile.

  2. La tassa di giudizio di Fr. 100.- e le spese di Fr. 50.- (totale Fr. 150.-) sono a carico degli appellanti.
