Omnilex summary

The Ticino Court of Appeal, Second Civil Chamber, held that a nullity appeal under Arts. 36 and 41 CIA is unavailable against decisions of the parity commission or appeal commission established by a collective labor agreement, because those bodies are not arbitral tribunals and their decisions are not arbitral awards. The appellant’s challenge to the 19 January 1999 decision concerning special salary agreements for 1997 was therefore declared inadmissible. The court further ordered that no court fees or costs be levied.

Omnilex headnote

Arts. 36 and 41 CIA; collective labor agreement committees and admissibility of a nullity appeal: parity commissions and appeal commissions established by a collective labor agreement are not arbitral tribunals. Their decisions therefore do not constitute arbitral awards susceptible to a nullity appeal. In the absence of a valid arbitral award, the appellate court must declare the remedy inadmissible (consid. referring to prior case law, Rep. 1995, 254).

rappr. dall’avv. __________

Considerato

che, come appare dalle argomentazioni della sentenza 15 novembre 1995 di questa Camera pubblicata in Rep. 1995, 254, la commissione paritetica rispettivamente quella di ricorso previste da un contratto collettivo di lavoro non sono tribunali arbitrali e le loro decisioni non sono lodi nei confronti dei quali è possibile il ricorso per nullità;

che, in mancanza di un valido lodo arbitrale, non vi può essere spazio per un ricorso in nullità ai sensi degli art. 36 e 41 CIA e quello presentato dalla __________ dev’essere di conseguenza dichiarato irricevibile;

che non si prelevano tasse o spese per il presente giudizio;

Per i quali motivi

Key legal question

Whether a nullity appeal lies against decisions of the parity/appeal committee under the collective labor agreement.

Extracted holding

No. Such committees are not arbitral tribunals, and their decisions are not awards that can be attacked by a nullity appeal.

Extracted reasoning

Relying on the Chamber's earlier case law, the court held that the parity commission and the appeal commission provided for in a collective labor agreement do not qualify as arbitral courts. Without a valid arbitral award, there is no room for a nullity appeal under Arts. 36 and 41 CIA.
