The appellant challenged a 3 May 1999 decision of the Bellinzona District Pretura before the Second Civil Chamber of the Ticino Court of Appeal. After being ordered to pay an advance on costs of CHF 300 by 14 June 1999, with the explicit warning that non-payment would cause the appeal to be treated as deserted under Art. 312 CPC, the appellant failed to pay. The court therefore struck the appeal from the docket and ordered that no fees or costs be taken.
Art. 312 CPC; failure to pay the advance on costs within the judicial deadline: where the appellant is duly warned that non-payment of the requested deposit will result in the appeal being treated as deserted, expiry of the deadline without payment justifies striking the appeal from the roll. The appellate court need not examine the merits once the procedural prerequisite is not fulfilled. If the decision states that no taxes or costs are levied, this is to be reflected expressly in the dispositive order.

Richiamata la diffida 27 maggio 1999 del presidente di questa Camera mediante la quale alla ricorrente veniva assegnato un termine scadente il 14 giugno 1999 per effettuare sul c.c.p. 69-10370-9 del Tribunale d’appello -introiti AGITI- un deposito di fr. 300.-- a titolo di anticipo per le presunte spese giudiziarie, con la comminatoria che, in caso di mancato versamento dell'importo entro il termine fissato, il ricorso sarebbe stato dichiarato deserto ai sensi dell'art. 312 CPC;
preso atto come il termine in questione sia infruttuosamente trascorso;
decreta 1. L'appello 25 maggio 1999 __________, rappr. dall’Am-ministratore unico signor __________ , avverso la decisione 3 maggio 1999 del Segretario assessore della Pretura di Bellinzona, è stralciato dai ruoli per mancato versamento dell'anticipo.
Non si prelevano tasse e spese.
