Richiamata la diffida 31 gennaio 1996 del presidente di questa Camera mediante la quale al ricorrente veniva assegnato un termine scadente il 19 febbraio 1996 per effettuare sul c.c.p. 69-10370-9 del Tribunale d’appello -introiti AGITI- un deposito di fr. 600.-- a titolo di anticipo per le presunte spese giudiziarie, con la comminatoria che, in caso di mancato versamento dell'importo entro il termine fissato, il ricorso sarebbe stato dichiarato deserto ai sensi dell'art. 312 CPC;

considerato

come il termine in questione sia infruttuosamente trascorso anche se l’appellante ha dato ordine di trattenuta del corriere in posta (cfr. avviso 1.2.1996 delle PTT Ufficio di Lugano);

che infatti l’ordine di trattenere il corriere in posta non é un modo di distribuzione che per le condizioni in cui deve svolgersi può influire sulla notifica di un atto giudiziario e che in tal caso l’atto si intende notificato l’ultimo dei sette giorni durante i quali, secondo i regolamenti postali, l’invio raccomandato rimane giacente presso l’ufficio postale (Cocchi/Trezzini, CPC, ad art. 124 n. 2);

che di conseguenza la mancata prestazione dell’anticipo comporta lo stralcio della procedura d’appello;

decreta 1. L'appello 29 gennaio 1996 di __________ (rappr__________, __________ ), avverso la decisione 3 gennaio 1996 del Pretore di Lugano -sezione 1-, è stralciato dai ruoli per mancato versamento dell'anticipo.

  1. Le spese del presente giudizio con tassa di giustizia per complessivi fr. 50.-- sono poste a carico dell'appellante.
