Omnilex summary

The First Civil Chamber of the Ticino Court of Appeal dealt with an appeal against a Lugano District Pretura judgment rejecting an action for maintenance. After the appellant was ordered to pay an advance on costs by 28 May 2002, the payment was made only on 29 May 2002. Because no request for restitution of time was filed, the court held the appeal untimely and did not examine the merits. It struck the appeal from the docket, charged the appellant with reduced costs of CHF 100, and denied party compensation because the appeal had not even been served on the respondents.

Omnilex headnote

Art. 312 cpv. 2 CPC; late payment of the advance for court costs as a ground for non-consideration of the appeal. If the appellant fails to pay the requested advance within the fixed period and does not seek restoration of the time limit under Art. 137 CPC, the appellate court may not enter into the merits. Where the appeal ends without a judgment, the procedural costs may be reduced under Art. 21 LTG; no party compensation is due if the appeal was not served on the opposing party (consid. 1-2).

__________, __________ __________ ____________________, ora in __________ __________ __________, __________x __________ __________, __________, e __________ __________, __________ (patrocinati dall'avv. __________ __________, __________);

visto l'appello del 6 maggio 2002 presentato da __________ __________ contro la sentenza del 23 aprile 2002 con cui il Pretore del Distretto di Lugano, sezione 2, ha respinto l'azione di manutenzione da egli intentata, ponendo la tassa di giustizia, le spese e le ripetibili a suo carico;

ricordato che il 10 maggio 2002 l'appellante è stato invitato a depositare entro martedì 28 maggio 2002, a titolo di anticipo per le spese giudiziarie presunte, la somma di fr. 600.– sul conto corrente postale --__________ del Tribunale di appello, introiti __________, con l'avvertenza che, decorso infruttuoso il termine, l'appello non sarebbe stato trattato (art. 312 cpv. 2 CPC);

accertato che nella fattispecie il versamento risulta essere intervenuto allo sportello postale di __________ __________ il 29 maggio 2002 (attestazione di __________, __________), senza che l'interessato abbia postulato un'eventuale restituzione del termine (art. 137 CPC);

ritenuto che nelle circostanze descritte il deposito si rivela tardivo, sicché l'appello non può essere esaminato nel merito;

considerato che gli oneri processuali vanno a carico di chi li ha provocati, ma che la tassa di giustizia dev'essere adeguatamente ridotta, la procedura di appello terminando senza sentenza (art. 21 LTG);

stabilito che non si giustifica di attribuire ripetibili alla controparte, cui l'appello non è nemmeno stato intimato;

richiamato l'art. 12 cpv. 1 e 2 LTG,

decreta: 1. L'appello è stralciato dai ruoli per tardivo versamento dell'anticipo.

  1. Gli oneri processuali, consistenti in:

a) tassa di giustizia fr. 50.–

b) spese fr. 50.–

fr. 100.–

sono posti a carico dell'appellante. Non si assegnano ripetibili.

Key legal question

Whether the appeal had to be examined despite the late payment of the advance for court costs.

Extracted holding

No. The advance was paid after the deadline, and no request for restoration of the time limit was made, so the appeal could not be examined on the merits.

Extracted reasoning

Under Art. 312(2) CPC, failure to pay the requested advance within the set time means the appeal is not dealt with. The payment on 29 May 2002 was late, and Art. 137 CPC was not invoked.

Key legal question

Allocation of procedural costs and party compensation in the appeal proceedings.

Extracted holding

The appellant had to bear the reduced appeal costs, and no party compensation was awarded because the appeal was not even served on the opposing side.

Extracted reasoning

Costs follow the party causing them, but the justice fee had to be reduced because the appeal ended without a judgment. No ripetibili were justified.
