Omnilex summary

The appellant withdrew two appeals pending before the First Civil Chamber of the Ticino Court of Appeal concerning an estate liquidation ordered in first instance by the Lugano Pretore. The court treated the withdrawal as desistance and struck the proceedings from the docket. It held the withdrawing appellant to be unsuccessful, but noted the parties' agreement to compensate party costs. Because the case ended without a merits judgment and the parties had shown good faith, the court reduced the judicial fee. Costs of CHF 150 were imposed on the appellant, while ripetibili were set off.

Omnilex headnote

Art. 352 cpv. 1 e 2 CPC; withdrawal of an appeal and allocation of costs. The withdrawal of an appeal is equivalent to desistance and leads to removal of the case from the docket. The withdrawing appellant is deemed unsuccessful and in principle bears the procedural costs. If the parties agree to compensate party costs, ripetibili are set off. Where the proceedings end without a decision on the merits and the parties have acted in good faith, the judicial fee may be reduced accordingly; Art. 21 LTG.

Key legal question

Whether the appeals should be struck from the docket after withdrawal by the appellant

Extracted holding

Yes. The withdrawal of an appeal is treated as desistance, so the cases are struck from the docket.

Extracted reasoning

The court noted the written withdrawal and stated that withdrawal of an appeal equals desistance.

Key legal question

How appellate costs and party expenses should be allocated after the withdrawal

Extracted holding

The appellant bears the procedural costs; party costs are set off by agreement.

Extracted reasoning

The withdrawing appellant is treated as unsuccessful. Because the parties agreed to compensate ripetibili, and the case ended without a merits judgment, the court reduced the judicial fee in light of the parties' good faith.
