premesso che il 12 settembre 1996 __________ __________ ha presentato appello contro il decreto cautelare emanato il 12 agosto 1996 dal Pretore del Distretto di Lugano, sezio-

ne 6;

preso atto che con lettera del 24 settembre 1996 l’appellante ha comunicato di ritirare il ricorso;

ricordato che il ritiro di un appello equivale a desistenza (Rep. 1978 pag. 375) e comporta – per principio – l’addebito degli oneri processuali a chi recede dalla lite, con obbligo di rifondere alla controparte una congrua indennità per ripetibili;

ritenuto che in concreto la tassa di giustizia deve essere equamente ridotta, la procedura non terminando con un giudizio di merito (art. 21 LTG), mentre non è il caso di attribuire ripetibili alla controparte, cui l’appello non è nemmeno stato intimato;

richiamato l’art. 352 cpv. 1 CPC,

decreta:

  1. La causa è stralciata dai ruoli per desistenza.

  2. Gli oneri processuali, consistenti in:

a) tassa di giustizia ridotta fr. 70.–

b) spese fr. 30.–

fr. 100.–

sono posti a carico dell’appellante. Non si assegnano ripetibili.
