Omnilex summary

In interim divorce proceedings, the appellant withdrew the appeal after the parties concluded and the first-instance court approved a settlement on accessory divorce consequences. The Court of Appeal treated the withdrawal as desistance and struck the appeal from the docket. It followed the parties’ agreement that no appeal-level compensation would be awarded and charged the reduced procedural costs, totaling CHF 100, to the appellant, taking into account the parties’ constructive settlement efforts.

Omnilex headnote

Art. 352 cpv. 1 CPC; withdrawal of an appeal as desistance and costs after settlement: the withdrawal of an appeal has the effect of desistance and normally entails allocation of procedural costs to the withdrawing party together with compensation to the other party. The appellate court may, however, give effect to a settlement by which the parties regulate costs and party compensation, provided there is no reason to depart from it. In fixing the court fee, the court may further take account of the parties’ good faith and willingness to settle the dispute (consid. 1).

__________, __________ (patrocinato dall’avv. __________ __________, __________);

premesso che il 9 ottobre 1995 __________ __________ ha presentato appello contro un decreto cautelare emesso il 26 settembre 1995 dal Pretore della giurisdizione di Locarno-Città;

preso atto che con lettera del 3 giugno 1996 l’appellante comunica di ritirare il ricorso, avendo firmato il giorno stesso una convenzione sulle conseguenze accessorie del divorzio, omologata dal Pretore;

ricordato che il ritiro di un appello equivale a desistenza (Rep. 1978 pag. 375) e comporta, in linea di principio, l’addebito degli oneri processuali a chi recede dalla procedura, con obbligo di rifondere alla controparte una congrua indennità per ripetibili;

accertato che, in virtù della citata convenzione sulle conseguenze accessorie, il marito rinuncia all’assegnazione di ripetibili per la sede di appello, mentre la moglie dichiara di assumere le spese processuali (punto 5);

ritenuto che non v’è motivo per scostarsi da tale accordo;

rilevato, in ogni modo, che nella determinazione della tassa di giustizia appare giusto tenere conto della buona volontà dimostrata dalle parti nel risolvere il contenzioso (art. 21 LTG);

richiamato l’art. 352 cpv. 1 CPC;

decreta:

  1. L’appello è stralciato dai ruoli per desistenza.

  2. Gli oneri processuali, consistenti in:

a) tassa di giustizia ridotta fr. 70.–

b) spese fr. 30.–

fr. 100.–

sono posti a carico dell’appellante. Non si assegnano ripetibili.

Key legal question

Whether the appeal should be removed from the docket due to withdrawal

Extracted holding

The appeal was struck off the docket as withdrawn.

Extracted reasoning

Withdrawal of an appeal is treated as desistance; the court therefore removed the appeal from the list of cases.

Key legal question

How procedural costs and party compensation should be allocated after withdrawal

Extracted holding

Costs were charged to the appellant and no party compensation was awarded.

Extracted reasoning

As a rule, the withdrawing party bears the procedural costs and must compensate the other party. Here, however, the divorce settlement waived compensation at appeal level and allocated costs to the wife, and the court found no reason to depart from that agreement; it also reduced the court fee in light of the parties' constructive settlement efforts.
