siccome

ritenuto colpevole di danneggiamento;

fatti avvenuti il 22 luglio 2006 a __________;

reato previsto dall'art. 144 cpv. 1 CP;

e meglio come al decreto d’accusa n. 4256/2006 di data 20 novembre 2006 del AINQ 1 per cui fu proposta la condanna

Alla multa di fr. 300.00. 2. Il rinvio della parte civile al competente foro civile per il risarcimento. 3. Al pagamento della tassa di giustizia di fr. 100.00 e delle spese giudiziarie di

fr. 100.00.

vista l'opposizione interposta dalla parte civile in data 15 dicembre 2006;

considerato che per gli art. 208 e 210 CPP l’accusato e la parte civile hanno il diritto di inoltrare al Procuratore pubblico opposizione scritta contro le proposte contenute nel decreto di accusa entro 15 giorni;

che il decreto di accusa è stato intimato per raccomandata alla parte civile al suo domicilio di Haan il 20 novembre 2006;

che tale atto gli è stato regolarmente notificato il 24 novembre 2006 (cfr. ricevuta di ritorno agli atti);

che di conseguenza il termine per formulare opposizione scadeva l’11 dicembre 2006, essendo i due giorni precedenti considerati festivi;

che l’opposizione interposta dalla patrocinatrice della parte civile, inoltrata unicamente il 15 dicembre 2006 (cfr. opposizione), risulta pertanto tardiva;

che ciò posto non è nemmeno necessario chinarsi sulla facoltà della patrocinatrice di parte civile di validamente poter rappresentare quest’ultima nella presente procedura;

che di conseguenza l’opposizione è irricevibile e il decreto di accusa definitivo;

pronuncia: 1. L'opposizione è irricevibile.

  1. Alla crescita in giudicato del presente giudizio l’incarto sarà retrocesso al Procuratore pubblico per quanto di sua competenza.
