ritenuto colpevole di conseguimento fraudolento di una prestazione, e contravvenzione alla LF sul trasporto pubblico;

fatti avvenuti in data 17 marzo 2003, sulla tratta __________ -__________;

reati previsti dagli artt. 150 CPS e 51 LTP;

e meglio come al decreto d’accusa no. DA / di data __________ 2003 del ___________ per cui è stata proposta la condanna del prevenuto:

  1. Alla multa di fr. 200.--, con l’avvertenza che la stessa deve essere pagata entro 3 mesi ritenuto che in caso di mancato pagamento, sarà commutata in arresto (art. 49 cfr. 3 CPS).

  2. Al versamento alla parte civile __________ dell'importo di fr. 130.- (centotrenta), a titolo di risarcimento (art. 208 cpv. 1 lett. b CPPT).

  3. Al pagamento della tassa di giusitzia di fr. 50.-- e delle spese giudiziarie di fr. 50.--.

  4. La condanna verrà iscritta a casellario giudiziale e sarà cancellata entro un anno, se l’imputato avrà pagato la multa e tenuto buona condotta (art. 49 cfr. 4, risp. art. 106 cpv. 3 CPS).

vista l'opposizione interposta tempestivamente in data 23 maggio 2003 dall'accusato;

considerato che - dai documenti ora agli atti, segnatamente dalla comunicazione 25 febbraio 2004 del difensore, dott. __________ __________, risulta che il prevenuto, in data 11 aprile 2003, ha versato alla parte civile, nel termine richiestogli di cui alla notifica di procedimento penale del 7 aprile 2003 del Procuratore Pubblico, l’importo, dovuto ed accertato, di fr. 130.- (centotrenta);

  • stante quanto precede il Ministero Pubblico recede dal perseguire penalmente il prevenuto, come avrebbe del resto già fatto a suo tempo, se solo il signor __________ __________ non avesse negligentemente omesso di comunicare da subito alle Autorità preposte l’avvenuto pagamento;

pronuncia: 1. Il decreto di accusa no. DA / del __________ 2003 del Procuratore Pubblico Antonio Perugini è annullato.

§ Di conseguenza non si fa luogo a procedimento penale nei confronti di __________ , per i fatti del 17 marzo 2003 sulla tratta __________ -.

§§ Di conseguenza il dibattimento penale, già fissato per il giorno 23 aprile 2004 alle ore 14:30 è annullato.

§§§ L’incarto è ritornato al Ministero Pubblico, per quanto di sua competenza.
