fatti avvenuti il 14 gennaio 2004 a Lugano;

reato previsto dall'art. 51 LTP;

e meglio come al decreto d’accusa n. DA 1363/2004 di data 26 aprile 2004 del _AINQ1 per cui fu proposta la condanna

  1. Alla multa di fr. 100.--.

  2. Al versamento alla parte civile FFS dell'importo di fr. 100.--, a titolo di risarcimento.

  3. Al pagamento della tassa di giustizia di fr. 50.-- e delle spese giudiziarie di fr. 50.--.

vista l'opposizione interposta tempestivamente in data 10 maggio 2004 dall'accusato;

considerato che - dai documenti ora agli atti risulta che il signor __________ ha versato alla parte civile, nel termine richiesto, l'importo di fr. 100.- di cui all'invito 29 marzo 2004 del Procuratore pubblico;

  • visto quanto sopra il Ministero pubblico recede dal perseguire penalmente contro il signor __________, come avrebbe fatto se egli non avesse negligentemente omesso di comunicargli il citato pagamento;

pronuncia: 1. Il DA 1363/2004 è annullato e non si fa luogo a procdimento penale nei confronti di __________ per i fatti del 14 gennaio 2004 a Lugano.
