con la quale l¿attore ha chiesto la condanna del convenuto al pagamento dell¿importo di Fr. 637'395.20 oltre interessi di mora a far tempo da varie scadenze mentre il convenuto, con risposta ed azione riconvenzionale 10 gennaio 2005, ha chiesto la reiezione della petizione e la condanna dell¿attore a versargli l¿importo di Fr. 118'825.- oltre interessi al 5 % dal 10 gennaio 2005.
Avendo il Presidente della Camera, in corso di istruttoria (cfr. verbale di audizione testimoniale del 24 febbraio 2006), formulato una proposta di soluzione transattiva della vertenza del seguente tenore:
CV 1 versa a AT 1 l¿importo omnicomprensivo (capitale, interessi, ripetibili) di Fr. 470'000.- a saldo di ogni e qualsiasi pretesa di quest¿ultimo sia nei confronti di CV 1 che di __________ SA.
L¿importo in questione dovrà essere versato entro il 15 aprile 2006.
La tassa di giudizio di Fr. 5'000.- è a carico di CV 1 ritenuto che a AT 1 verranno restituiti gli anticipi già prestati.
che le parti hanno formalmente accettato con dichiarazioni scritte 27 febbraio 2006 l¿attore e 24 marzo 2006 il convenuto.
Ritenuto che la parte attrice ha comunicato, in data 14 aprile 2006, che la controparte ha provveduto al versamento della somma di Fr. 470'000.-.
Dovendosi così stralciare la procedura dai ruoli per intervenuta transazione.
Visti l¿art. 352 CPC e la vigente TG
dichiara e pronuncia
La causa inc. no. 10.2004.14 proposta direttamente in appello da AT 1 contro CV 1 con petizione 7 ottobre 2004 è stralciata dai ruoli per intervenuta transazione.
La tassa di giudizio e le spese di complessivi Fr. 5'000.- sono a carico di CV 1.
